Party Walls

The Party Wall etc. Act 1996 applies throughout England and Wales and provides a framework for preventing and resolving disputes in relation to party walls, party structures, boundary walls and excavations near neighbouring buildings.

The Act places a responsibility on a building owner who intends to undertake works to a party structure, excavations within 3 or 6 metres of a neighbouring property, or on the party line where no building exists.

Any building owner planning to undertake works covered by the Act must serve notice to the adjoining owner in accordance with the procedures set out within the Act. Adjoining owners can either consent or dissent, in which case a dispute is deemed to have arisen. This then triggers the appointment of Party Wall Surveyors under the Act.

At the Easterling Marsh Partnership we can ensure that any disagreements are resolved in a fair and practical way with the issue of a Party Wall Award.

Whether you are planning on undertaking work, or your neighhbour has served notice upon you, we can assist in ensuring that either the building works are undertaken with a minimum of inconvenience or, alternatively, that your rights are protected and your property safeguarded should damage occur.
